Terms of Trade
Quotes and Estimates:
Quotes are a fixed price offer of works, only valid for 1 month and subject to change in raw materials costs. The current climate is unpredictable so we are advising all of our customers to allow an additional 10% in their budget.
Estimates are a little more flexible and should only be used as a guide price for the expected outcome. When lead times exceed 3 months, it is normal practice for us to estimate works until such time a quote can be supplied.
Booking:
To book Paved In Stone Ltd, we require a Mobilisation fee of 10% the total value of your quote. This fee will secure your place in our diary and is subject to the standard 14 day cooling off period after payment has been received.
We will compile a contract for both parties to sign, either on, or prior to the first day of work. This contract will include documents you should have already received from us via email, such as your accepted quote, our terms and conditions, and any other relevant drawings or instructions.
In the event of cancelling a booking, at any time, Paved in Stone reserves the right to charge an administration fee for any materials, tool hire and labour that has already been arranged and assigned to your project, at the point of cancellation. This fee, along with any downpayments to reserve stock or special orders, will be deducted and billed accordingly from your Mobilisation payment refund.
Subcontracting
Paved in Stone Ltd will happily work alongside other contractors as part of bigger projects, or stand alone jobs, under the same terms as members of the public.
Extra Works:
Any extra work shall be agreed upon in writing by both parties before extra costs are incurred.
This may include extended plans, changes of work due to no fault of Paved In Stone, Ltd, or unforeseen conditions such as soft or hard ground.
Payment:
Payment is preferred via BACS transfer and is expected upon request as per the payment plan* presented in your quote. We will also accept cheques in £5k or less increments
OUR BANK ACCOUNTS WILL NOT CHANGE, PLEASE BE DILIGENT WITH SCAM EMAILS.
* Payment plans are used for larger projects to ensure vital cash flow. These payments are normally structured according to progress and in effect becomes a “pay as you go” type arrangement. We generally don’t offer payment plans for projects under £10k, in these cases we send an invoice on the day of completion, payment plans for these projects are available upon request.
We will be entitled to suspend or terminate the contract if the client fails to pay any sum due to us in accordance with our agreed payment plan. At which point, we will be entitled to full payment of all goods and labour supplied to the date of suspension or termination.
In the event of a contract being suspended, it may not always be possible for us to re-commence work once payment is resolved, but we will endeavour to do so as soon as possible. We do not accept any liability for extra expense or inconvenience caused.
ALL PAYMENTS ARE DUE UPON REQUEST/ COMPLETION
Expectations of Work Agreed:
You, the client, should be in no doubt what you can expect from your quote from Paved In Stone, Ltd.
We have strived to give you as much information as is practically possible for you to make an informed decision on your project.
If you are unsure about any of the elements of work, please tell us so we can help before installation takes place.
Any alterations in work done due to changes in expectations not fully communicated to us will be deemed as extra work and charged accordingly.
Product Aftercare:
We have provided you with a guide on how to look after your project in the years that follow. Most projects are low maintenance. However, there's no such thing as maintenance free.
We do not accept responsibility for any live plant material, including turf, following its practical substantial completion.
We do not accept any responsibility for damage caused by the environment including wind, rain, frost, drought or animal damage.
Working Environment:
The client must supply a clean, safe source of electricity and water at no cost to Paved In Stone, Ltd.
Paved In Stone, Ltd requires free and uninterrupted access to and from your site to operate effectively, this includes spaces for our employee vehicles as well as delivery of goods in and out.
Paved in Stone, Ltd will manage and coordinate with third parties supplying goods or services to the project.
Paved In Stone, Ltd will supply an independent toilet with hand sanitising facilities.
Image Rights:
Paved In Stone, Ltd may use photographs and/or video of your project for advertising and portfolio purposes. We make every effort to ensure we are not identifying you, or your address.

Unless otherwise stated by the client, Paved In Stone Ltd, assumes you agree.
Damages/ disruptions
We will make every effort to accommodate everyone's access and right to peace and quiet at home, however there are inevitable disruptions during the average course of any given project to both you, the client and your neighbours.
This can include, and are not limited to, lorries blocking access for up to 30 minutes and noise from small machinery such as diggers or stone cutters.
We would appreciate you informing your neighbours of the upcoming project.
We accept no liability for costs in damages, delays or disruption caused by third party delivery vehicles.
We accept no liability for any damage caused to any underground services, including gas, water and electricity, that are not clearly marked with warning tape or sand in a suitable trench at a minimum depth of 600mm below ground level.
Changes to Work Done:
Sometimes it can be difficult to visualise what something might look like from landscape design to reality. Paved In Stone, Ltd makes every effort to clearly communicate what is happening and what it will look like. Any changes to work done that are not the result of faulty workmanship, miscommunication (within reason) or faulty product will be charged as extra work, accordingly.
CDM regulations 2015
Construction Design Management, or CDM, regulations aim to improve the safety and management of all parties involved in any given construction project.
We will issue your CDM as part of your contract, it must also be signed by all parties.
Leftover Products:
It is not uncommon to have surplus materials at the end of a project, in such cases all products surplus to the project's completion remain the property of Paved in Stone, Ltd and will be removed from site.
Our Commitment to You:
Paved In Stone, Ltd agrees to follow the Terms and conditions, Working Practices and CDM on all projects.
Paved In Stone, Ltd agrees to keep the site as tidy and safe as practically possible at all times.
Paved In Stone, Ltd agrees to inform the customer of any design changes or unforeseen work at the earliest opportunity and before any extra costs are incurred.
Paved In Stone, Ltd promises to look after your investment and observe best practice ( BS 7533 ) at all times.
Warranty:
Any defects in your project, which results directly from our faulty workmanship, or products we have supplied, will be repaired at our cost if the fault arises and is reported within 6 months of practical completion.
The above warranty does not extend to defects arising from the clients own actions or neglect, including without limitation, inadequate maintenance, deliberate damage, removal or misuse.
We will not be held liable for any changes in ground conditions outside of our scope of works that may cause defects to your project, for example, clay heave caused by extreme heat or flood, can result in movement of the ground underneath the paving, and indeed, the surrounding areas. This movement can exert forces far beyond the specification of domestic paving, therefore, these instances are considered the homeowners responsibility, providing the work from Paved in Stone Ltd meets or exceeds BS 7533.
After the initial 6 month period any repairs required will be assessed on a case by case basis.
Under no circumstances shall Paved in Stone, Ltd be liable for any amount of money greater than the original contract.
Marshalls 10 Year Hard Landscaping Guarantee:
As we are Marshalls Accredited Contractors, we can offer you a genuine guarantee on your paving project, underwritten by Marshalls insurers, you can effectively insure your project, should anything go wrong.
Available for £50 plus vat for every £5000 spent on a project consisting of at least 70% Marshalls products. More details available on request.
Complaints:
We make sure to regularly check in with the customer to confirm our plans are on track. We prefer to deal with any problems as they happen, so the first step in our complaints procedure is communication.
In the unlikely event that things cannot be resolved, FULL payment of any materials, hire contracts or sub-contract labour to date MUST be paid and a notice of cancellation must be issued and agreed by either party.
As a Marshalls Accredited Installer we have a facility to include them to assess and mediate most issues, even if you do not have a Guarantee Agreement with Marshalls.
We would also welcome your own appointment for assessment but we will only recognise court appointed experts.
